Condo Manager Evicting My Dog?

I just received a notice from my condo manager that I am being fined for having my dog and he is to be removed immediately! He is my family I can not "Get rid of him!" I am trying to get a note from a therapist I am a full time medical student and My dog keeps me from quiting any advice?

I know how your dog can be a sanity-saver, mine is for me. I would get a copy QUICK of your landlord-tenant laws. Every eviction involves three months of notices (except for truly criminal activity like arson) and it sounds like you are being denied due process. Also, ask at your local humane society about foster care for your dog during this emergency. Then get online to your dog's breed club (even if not registered or purebred) and get into their chat room, and cry help for foster care! Hang in there, this is just one of the many things that you will look back on after you've graduated and say Did I really survive that!? Best of blessings to you!

Just out of the blue he's doing this? Is the dog not supposed to be there at all? Doesn't sound legal to me. There are organizations that help people who medically need dogs & I doubt he will be able to make it stick.

He also can't just do it instantly. All laws have a period of time before they can be enforced. I would look in the yellow pages for therapy dog organizations. & see what they can do for you.

Tenant laws vary from state to state. Here in AZ, the landlord could refuse your rent, then evict you for non-payment, and it's over in a matter of days.
I just noticed that you're in Tempe, and I have to say that the laws don't favor the tenants in our state. As a matter of fact, the eviction may occur because you didn't provide the therapist's note before gettting the dog.

Hi you didn't say if you were renting or if you are buying the condo and if you are buying they have no say what pets you have in your house the only say they have is what goes on, on the outside of your condo, it's your home.. If you are renting it should have been in the rental agreement from the get go that you signed that no pets are allowed on the property, unless it states that in your lease they don't have a leg to stand on and you have rights at that point.. Check your neighbors they probably have pets as well and see if they got the same notice..

If you can get a note from the therapist and are willing to do the work, research Americans With Disabilities Act. www.usdoj.gov/.../adahom1.htm This is a federal law that covers the rights (among many other rights) that persons with disabilities (and anyone who has a theraputic need for a service animal of any kind should qualify under that act) to be able to have service animals )You dog is your service animal.

But you will have to do the research. But you still may have to get a lawyer because not everyone will voluntarily follow the law. But be sure to go to that federal site first, because it will give you the info to fight with.

did your dog or really you behavve badly?? or are there rules stating no dogs or animals in condo?? if the behavior is a question get the dog liscened in your town or county then take him or at least get registerd for behavior classes and then make sure you have an attendacne record to give the manager.

Just so you know, the ADA (American Disabilities Association) protects you COMPLETELY in this. You do NOT technically need ANY proof... although a doctors note or vest for your dog to wear outdoors would probably minimize your need for arguing with the management. But LEGALLY they cannot require proof of your disability (be is physical or mental). You can actually sue them and win it if they even ASK you for proof, once you state that it is a service dog.

P.S. you are also not required to leave a pet deposit.

My mother has a service dog, and this is exactly what we learned from the tedious experience. all she does to stop harassment, is carry around a sheet she printed off the ADA website stating all these rules & more, and their telephone number (so if the person has any questions, they can call THEM directly, instead of hassling her more about it). And she carries that in her purse.

Do you have a lawyer you can talk to? Maybe there is something you can do. Did your contract say "No Pets" when you moved in? If not, he may be wrong to fine you. It's difficult enough to be in school without having to go through this sort of heartbreak.

Does you dog create a disturbance while you are gone? If so, there is something the vet can give you for him for separation anxiety. Don't give up trying. I'll be thinking of you.

Don't you have to actually be disabled or have a medical necessity to have a service animal? If you are, fight. If you are not, I sure wouldn't proceed in that area. Using any law for your own gain could get you in more trouble.

Your dog is very cute. I'm not really sure but it looks like he might have some bulldog in him. They get a bad rap sometimes. And many insurance companies will not insure you if you have a bulldog on the property. This may be the case with the landlords insurance. I know it is with ours. Just a thought. Good luck. I hope you can get it worked out somehow.
