Medicaid and Marriage?

I live in New Mexico and want to get married, but I am in stage 5 kidney failure and I can't lose my Medicaid. What can I do and still get married? We only make about $2,500 a month together.

When you get married, the two incomes are combined. If you both make less than the maximum, you will still be qualified. Check this out before you tie the knot!

I do not know how you are figuring your monthly income - is the $2500 before taxes are removed?
Medicaid looks at total income before taxes so you will need to know that amount before you can determine if you will still qualify.

  • Fact: $2500 monthly will equate to approximately $30,000 yearly income.
  • Here is an excerpt from the New Mexico Medicaid website:
  • "In order to qualify, you must have an annual household income (before taxes) that is below the following amounts:
  • Household Size Maximum Income Level (Per year)
  • 1 - $15,800
  • 2 - $21,307
  • 3 - $26,813
  • It does appear that your combined income would place you above the qualifying amount but I believe you should check with your local agency before making any decisions.
  • Just be sure that whatever you do, you are always truthful and keep all the special rules when dealing with any government agency.
  • There may be some special rules for cases like yours so be sure to check it out so you will know for sure (and not be guessing) as they are the only people who can state the facts in your case.

Medical assistace is tricky, highly regulated, and very complicated when it comes to eligibility.

Having esrd, is at least in my state, is a special situation that has an extra level of elgibility requirements around it. Please ask the experts at the state agency before making any decisions. If you don't get the answers you need or have trouble understanding the answers, get your state senator involved.

I hate saying all this because marriage is sacred and should be a joyous time for all, but protecting your health and benefits that pay for your care is critical to keeping you healthy so you can enjoy time with your honey!!

so question your reason for getting married, especially if you have this situation. What is the desire and benefit? If it's simply to have a nice ceremony, you can do so and not risk your life saving benefit by simply having a nice party or whatnot. If its about allocating and conjoining resources you could create a will (if you're thinking about your partner getting resources after you pass on) or get a joined bank account

it seems risky to get legally married and you may want to see why you wish it and if an alternative is availabe instead
