Eligibility for Survivor Benefits?

My husband and I separated and during the separation I got pregnant by someone else. We decided to work on things and he still signed the birth certificate. Now that he passed away if a paternity test is done even though he signed the birth certificate would that stop my child's benefits?

The only person who can answer this is the SSI office. You will need to make an appointment with one of the social workers in the office. They can handle the paperwork and answer all of your questions.

You need to make an appointment work social security. If I were you I would consult with a lawyer, too. The legal aid society provides lawyers for those who cant pay

I think you will find online SS survivor benefits say they cover you and the child. It says something like "a child who was dependent upon him at death". I was remarried at the time of my child's fathers death. No paternity test was asked for. Birth certificate was all they wanted.

I called on the phone, they took info, then scheduled an appointment. Very easy process. The Check was more than divorce/child support. Kinda sad that a child gets more if parent dies than child support settlements. Child got a check until 18. I did not qualify because I was remarried.

if he signed the birth certificate, that makes him the legal father whether his is the biological father, or not, is another issue. So Im assuming since he legally claimed the child as his, he would be eligible for survivors benefits.

Until age 18, or longer if hes still a student I believe. I would suggest you send him to college if you can, the monthly check would help cover his expenses while hes studying.
