Receiving Social Security Survivor Benefits?

My kids' dad was killed in an accident and my kids receive survivor benefits. Now there is someone saying he has another kid and they want to do DNA to see. How will this effect the benefits my kids receive now which isn't much because he didn't work much? Will it lower the amount they receive every month?

Only Social security can give you a correct and complete answer.

  • It is possible the SS may be able to answer your question over the phone but they would most likely not be able to give you money figures.
  • I believe there is a family limit and this may cause a problem if another child is added and even more so if the child is young and the mother is entitled to a benefit.
  • This is a very complicated matter and you should make an appointment and go to your SSA office soon so you can be prepared.

He didn't even know about her and we arnt forsure she is his there's no DNA test or anything . Thanks for getting back with me

This sounds a bit complicated and not really much you can do right now about all this. Was your husband paying child support for this child, did he even know he had the child? These are all the types of questions that you may or may not know the answer to. Anyhow, this will all be up to SS to decide on what they will do or not do for this child.

I'm not sure if you have to agree to the DNA test or not. This will all be questions that will be answered once you talk with SS about the problem and what they want to do about this.

If there is proof that he is indeed the father, the benefits may decrease. However, Social Security has the final say in this matter.

Just be aware that if the mother makes application to the SSA they will inform her of what she has to provide as proof that the child is your husband's child.

There may be things that you do not know but it will take a legal DNA and probably more for SS to approve this claim.
I believe it would be more beneficial for you to put this aside until there is some sort of communication (to you) from SSA about this claim as whatever it comes to, you will not have any control over what the SSA decides.

I can assure you, the SSA does not take something like this lightly and will not approve her claim unless they are absolutely sure the child is your husband's child.
