Child Receiving Social Security Benefits After Father's Death?

My son's father recently passed. We were not together and even though he didn't sign the birth certificate and wouldn't give his DNA for child support he was put down as the father and was ordered to pay child support, since he wouldn't fight it. My son is 4 years old. Will he receive a check off his father?

Receiving Social Security death benefits for your child is federal and not state ordered. Take a copy of the child support order to your local Social Security office and they will help you. They will require you to fill out an application and supply other documents as well but initially showing them the court order should get the ball rolling.

I have a business providing paper work for people who want to file for divorce, which of course also requires this knowledge when there are children. The people save hundreds of dollars because they do not have to pay attorney fees. Regarding the support, it's too bad that he didn''t allow proof as to weather he really is the father or not, however since he was ordered to pay support I believe you should receive the SS.

The only catch is that the Friend of the court is the one that orders the support and I live in Michigan. It may be different in your state, but I doubt it. You would require a blood test to prove he is the father and it's too late to get a blood test. The order from the FOC should be sufficient.

One more thing; if you don't already have one you will definitely need a copy of the father's death certificate.

Gina; You will need a copy of the death certificate, which you can get at the funeral home that took care of his death and a copy of the support order, which you received from the FOC. Deeli is correct, this is Federal. The comment to "Get A Job" from Chlo--She needs to acknowledge that our great president is pushing all this to support low income people and there are so many people out of work right now, that he was voted back in.

I am like her, very tired of seeing all the people who are driving better auto's than mine, and drawing food stamps. As soon as he got in office he gave all of those families $100 more per month. I advised you call in case they require anything else. And -- may still be able to do it by phone. And Chlo - needs to fight the "freebies" not SS.

The deceasedents mother might have to provide her DNA. Parenthood can be established under the law. If mother isn't possible then his father.
